PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK,

TERMS OF PARTICIPATION & MEDIA RELEASE

PLEASE READ THIS AGREEMENT CAREFULLY.

This Agreement contains important legal rights and obligations, including a release of liability, assumption of risk, waiver of certain legal claims, and authorization regarding photographs and video recordings. By electronically accepting this Agreement, you acknowledge that you have read, understand, and voluntarily agree to all of its terms.

1. PURPOSE OF THIS AGREEMENT

This Agreement applies to all activities organized, operated, sponsored, promoted, or conducted by GR Rec Sports, LLC ("GR Rec Sports"), including but not limited to recreational sports leagues, tournaments, pickup games, clinics, instructional programs, social events, championship events, charity events, volunteer activities, youth and family activities, and any other activity conducted now or in the future by GR Rec Sports.

This Agreement applies to participation at any park, gymnasium, field, court, facility, parking area, sidewalk, or other location utilized by GR Rec Sports.

By registering for, attending, volunteering at, or participating in any GR Rec Sports activity, I voluntarily agree to the terms contained in this Agreement.

2. ACKNOWLEDGMENT OF VOLUNTARY PARTICIPATION

I acknowledge that my participation in GR Rec Sports activities is entirely voluntary.

I understand that I am under no obligation to participate and that I have freely chosen to participate after considering the risks involved.

I further acknowledge that I have had sufficient opportunity to read this Agreement, ask questions if necessary, and seek independent legal advice before accepting it.

3. ELIGIBILITY AND HEALTH CERTIFICATION

By participating, I certify that:

I am physically capable of participating in the activities for which I have registered.
I have not been advised by a physician or other qualified healthcare professional to refrain from participation.
I will participate only within my own physical abilities and limitations.
I accept full responsibility for monitoring my own physical condition before, during, and after participation.
I understand that GR Rec Sports does not provide medical evaluations or determine whether I am physically fit to participate.

If at any time I believe participation may be unsafe due to illness, injury, fatigue, weather conditions, or any other circumstance, I agree to immediately discontinue participation.

4. AGREEMENT TO FOLLOW RULES AND INSTRUCTIONS

I agree to comply with all league rules, facility rules, posted notices, safety requirements, and reasonable instructions provided by GR Rec Sports staff, officials, volunteers, contractors, or facility personnel.

I understand that failure to follow rules or instructions may result in removal from an activity without refund and may result in suspension or permanent removal from future GR Rec Sports activities.

5. ASSUMPTION OF RISK

I understand and acknowledge that participation in recreational sports and related activities involves inherent and unavoidable risks that cannot be completely eliminated regardless of the care taken by GR Rec Sports.

I voluntarily and knowingly assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable.

These risks include, but are not limited to:

Being struck by balls, bats, paddles, rackets, sporting equipment, or other objects.
Collisions with other participants, officials, spectators, or fixed objects.
Falls, slips, trips, diving, sliding, jumping, running, throwing, kicking, or other athletic movements.
Uneven playing surfaces, holes, mud, wet grass, gravel, pavement, curbs, bleachers, sidewalks, parking lots, and naturally occurring field conditions.
Weather conditions including heat, humidity, cold, rain, wind, lightning, poor visibility, smoke, poor air quality, and other environmental conditions.
Equipment malfunction, equipment failure, or misuse of equipment by myself or others.
Actions, negligence, or misconduct of other participants, spectators, officials, volunteers, or third parties.
Physical exertion that may result in strains, sprains, fractures, concussions, dehydration, heat-related illness, cardiac events, paralysis, permanent disability, or death.
Risks associated with travel to and from league activities and movement throughout facilities used by GR Rec Sports.
Any other risks inherent to athletic participation or recreational activities.

I understand that these risks may arise from my own actions, the actions of others, the condition of facilities, equipment, weather, or circumstances that cannot be anticipated or controlled.

I voluntarily accept and assume all such risks.

6. PROTECTIVE EQUIPMENT

I understand that certain positions or activities involve greater risk than others.

GR Rec Sports strongly encourages participants to wear appropriate protective equipment whenever they believe it is appropriate for their chosen activity or position.

Unless specifically required by league rules, the decision whether to wear optional protective equipment remains entirely my responsibility.

I acknowledge that choosing not to wear available protective equipment may increase my risk of injury, and I voluntarily accept that risk.

I further understand that the presence or absence of protective equipment does not eliminate the inherent risks associated with recreational sports.

7. WEATHER AND ENVIRONMENTAL CONDITIONS

I understand that outdoor athletic activities are subject to changing weather and environmental conditions.

GR Rec Sports may delay, suspend, shorten, relocate, or cancel activities whenever staff reasonably determine that conditions may create an unreasonable safety concern.

I understand that weather conditions may change rapidly and that participation during changing conditions involves inherent risks.

I agree that the ultimate decision whether to participate remains my own.

8. MEDICAL TREATMENT

If I become injured or experience a medical emergency during a GR Rec Sports activity, I authorize GR Rec Sports staff, officials, volunteers, contractors, or other reasonably available individuals to seek emergency medical assistance on my behalf when they believe such assistance may be necessary.

I understand that GR Rec Sports does not provide medical insurance.

I accept full responsibility for all medical expenses incurred as a result of my participation.

I understand that any first aid supplies or assistance provided by GR Rec Sports are offered solely as a convenience and do not constitute professional medical care.

I release GR Rec Sports from any claim arising out of emergency assistance requested or provided in good faith.

9. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in any GR Rec Sports activity, and to the fullest extent permitted by applicable law, I voluntarily release, waive, discharge, and covenant not to sue GR Rec Sports, LLC, together with its owners, officers, directors, employees, independent contractors, officials, referees, umpires, volunteers, agents, sponsors, affiliates, venue owners, facility operators, municipalities, and any other persons or entities acting on its behalf (collectively, the "Released Parties"), from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, or attorney fees arising out of or related to my participation in any GR Rec Sports activity.

This release applies whether such claims arise from ordinary negligence, premises conditions, acts or omissions of other participants, spectators, volunteers, contractors, weather conditions, equipment, facilities, transportation associated with league activities, or any other circumstance inherent to participation in recreational sports, except where prohibited by applicable law.

I understand that this Release is intended to be interpreted as broadly as permitted under Michigan law.

10. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, lawsuits, liabilities, damages, judgments, settlements, costs, or expenses (including reasonable attorney fees) arising from:

My actions or omissions.
My violation of league rules or facility rules.
Damage to property caused by my negligent, reckless, or intentional conduct.
Claims brought on my behalf or by others arising out of my participation where legally permitted.

This obligation survives the conclusion of my participation in GR Rec Sports activities.

11. PROPERTY DAMAGE

I agree to exercise reasonable care while using facilities and equipment associated with GR Rec Sports.

I accept responsibility for damage to facilities, equipment, or property caused by my negligent, reckless, intentional, or unlawful conduct.

Normal wear and tear associated with ordinary recreational use is excluded.

12. CODE OF CONDUCT ACKNOWLEDGMENT

I acknowledge that participation in GR Rec Sports is conditioned upon compliance with the GR Rec Sports Code of Conduct.

I understand that GR Rec Sports reserves the right to remove, suspend, or permanently prohibit any participant whose conduct jeopardizes the safety, enjoyment, fairness, or integrity of league activities.

Removal from an activity or league under the Code of Conduct shall not entitle me to a refund unless otherwise required by applicable law or expressly provided under GR Rec Sports policies.

13. PHOTOGRAPHY, VIDEO & MEDIA RELEASE

I understand that photographs, video recordings, livestreams, audio recordings, and other media may be captured during GR Rec Sports activities.

I irrevocably grant GR Rec Sports, LLC the unrestricted right to photograph, record, reproduce, publish, display, distribute, edit, modify, create derivative works from, and otherwise use my name, image, likeness, voice, appearance, team name, and participation for any lawful purpose, including but not limited to:

Marketing and advertising.
Social media.
Website content.
Promotional materials.
Printed publications.
News releases.
Sponsor presentations.
Historical archives.
Future promotional campaigns.

I understand that I will receive no compensation for such use.

I waive any right to inspect or approve the finished product or the manner in which such media is used.

This authorization is perpetual, worldwide, royalty-free, and may be exercised in any media now known or later developed.

14. ELECTRONIC ACCEPTANCE

I agree that selecting an electronic checkbox, clicking "I have read and Agree to the participation waiver," completing registration, submitting payment, or otherwise electronically accepting this Agreement constitutes my legal signature.

I agree that electronic acceptance shall have the same legal force and effect as a handwritten signature.

I further acknowledge that I have had the opportunity to read this Agreement before electronically accepting it.

15. DISPUTE RESOLUTION

The parties agree to first attempt to resolve any dispute arising from this Agreement through good-faith discussions.

If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Kent County, Michigan, in accordance with the rules of the American Arbitration Association (AAA), unless another procedure is required by applicable law.

The arbitrator's decision shall be final and binding upon the parties.

To the extent permitted by law, both parties waive any right to trial by jury and any right to participate in a class or collective action.

16. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Michigan without regard to conflict-of-law principles.

17. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

Any invalid provision shall be modified only to the extent necessary to make it enforceable while preserving its original intent whenever possible.

18. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the participant and GR Rec Sports concerning the subject matter addressed herein and supersedes all prior oral or written discussions relating to participation in GR Rec Sports activities.

No verbal statement, representation, or promise by any employee, official, volunteer, contractor, or representative shall modify this Agreement unless expressly authorized in writing by GR Rec Sports.

19. ACKNOWLEDGMENT

BY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT:

I HAVE CAREFULLY READ THIS ENTIRE AGREEMENT.
I FULLY UNDERSTAND ITS TERMS.
I UNDERSTAND THAT I AM WAIVING CERTAIN LEGAL RIGHTS.
I UNDERSTAND THAT RECREATIONAL SPORTS INVOLVE INHERENT RISKS OF SERIOUS INJURY, PERMANENT DISABILITY, OR DEATH.
I VOLUNTARILY ACCEPT THOSE RISKS.
I AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.
I HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE BEFORE ACCEPTING THIS AGREEMENT.

BY SELECTING THE REQUIRED CHECKBOX DURING REGISTRATION, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THIS PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, TERMS OF PARTICIPATION, AND MEDIA RELEASE.
